Acceptance of these terms

This website is operated by Keylumi (Pty) Ltd. By accessing or using it, you agree to these Terms and Conditions. If you do not agree, you should stop using the website.

These terms apply to the website and general enquiries. Any development, design, maintenance or consulting work is governed by the proposal, statement of work or service agreement accepted for that project. If project terms conflict with these website terms, the signed project terms will apply to the service.

02

Acceptable website use

You may use this website for lawful information and enquiry purposes. You may not:

  • attempt to gain unauthorised access to the website, server or connected systems;
  • introduce malicious code or interfere with website availability;
  • use website content in a misleading, unlawful or harmful way;
  • scrape, reproduce or distribute substantial content without permission; or
  • misrepresent your identity or authority when contacting us.
03

Services, estimates and proposals

Information on this website describes our general capabilities and is not a binding offer, fixed quotation or guarantee that a particular service, technology or delivery date is available.

Project scope, deliverables, responsibilities, assumptions, fees, payment milestones, ownership, support and timing will be defined in the applicable written proposal or agreement. Work begins only after the required agreement and initial payment conditions have been met.

04

Client responsibilities

For an active project, the client is responsible for providing accurate requirements, lawful content, system access, feedback, decisions and approvals within the agreed timeframes. Delays or changes may affect delivery dates, cost or scope.

The client must have the necessary rights and permissions for any text, images, data, software, trademarks or other material supplied to Keylumi.

05

Intellectual property

The Keylumi website, brand, original copy, visual design and supporting materials are protected by applicable intellectual property law. You may view and share links to public pages, but may not reproduce or commercially exploit substantial website content without written permission.

Ownership and licensing of project deliverables, source code, pre-existing components, third-party software and client materials will be set out in the relevant project agreement.

Client and third-party names, logos and project imagery shown in our portfolio remain the property of their respective owners and are used to describe relevant experience and completed work.

06

Payment terms

Website access is free. Fees for professional services are specified in the applicable proposal or agreement. Unless that agreement states otherwise, invoices are payable by the stated due date and work may be paused where an amount is overdue.

Third-party costs such as hosting, software subscriptions, app-store fees, licences or external services may be charged separately where agreed.

07

Confidentiality and submissions

Do not send passwords, production credentials or highly sensitive personal information through a general website enquiry. Confidential project information should be shared through an agreed secure channel.

Information submitted in an enquiry may be used to evaluate and respond to that enquiry in accordance with our Privacy Policy. Submitting an idea does not create a confidential, fiduciary or service relationship unless separately agreed in writing.

08

Third-party services and links

The website may link to WhatsApp, LinkedIn, client websites and other external services. These services are operated independently, and Keylumi is not responsible for their availability, security, content or practices.

09

Website warranties and liability

The website and its public content are provided for general information. While we aim to keep information accurate and available, the website is provided as is and may contain errors, omissions or temporary interruptions.

To the maximum extent permitted by law, Keylumi is not liable for indirect, incidental, special or consequential loss arising solely from use of, or inability to use, this website or reliance on its general content. Nothing in these terms excludes liability that cannot lawfully be excluded.

10

Changes and governing law

We may update these terms when the website, our practices or applicable requirements change. The current version and last updated date will be published here.

These website terms are governed by the laws of the Republic of South Africa. Any dispute relating solely to these terms is subject to the jurisdiction of the appropriate South African courts.
